Terms of Service

1. Agreement to these terms

These Terms of Service (the “Terms”) are a binding agreement between you and Pedro Guitián, Juan Otero, and Hernando Ardila, doing business as GoBlume (“GoBlume”, “we”, “us”), covering the goblume.ai website and the waitlist (together, the “Site”). By using the Site or joining the waitlist, you agree to them. If you do not agree, please do not use the Site.

When GoBlume launches, the paid product will have its own terms that you will be asked to accept at that time. These Terms cover the pre-launch Site only.

2. Who may use the Site

You must be at least 18 years old and able to form a binding contract. If you are joining on behalf of a company, you confirm you are authorized to bind it.

3. The waitlist

This is the part worth reading carefully. Joining the waitlist:

• Is free, and is not a purchase. No payment is taken, no subscription starts, and no account is created.
• Does not guarantee access. We may open access in stages, in an order we choose, or to a limited number of people. We may also decline to offer access to anyone, and we may close, pause, or cancel the waitlist entirely.
• Comes with no timeline. Any launch date we mention is an estimate, not a commitment.
• Signs you up for email from us about the launch. You can unsubscribe from any of it at any time using the link in any email we send.

You agree to give us an email address you are entitled to use, and not to submit other people’s addresses or use automated means to submit the form.

4. Pricing shown before launch

Any prices, plans, or feature lists on the Site describe what we intend to build and charge. They are indicative, not an offer, and they may change before launch. Nothing on the Site locks in a price for you. If we offer waitlist members a specific price or discount, that offer will say so explicitly and will set out its own conditions.

5. Descriptions of the product

The Site describes a product under development. Features described may change, be delayed, or never ship. Screenshots and dashboards shown on the Site are illustrations using sample data, not the output of a live account.

We do not guarantee results. GoBlume is intended to help you understand and improve how AI systems reference your website. Those systems — including ChatGPT, Google’s AI features, Gemini, and Perplexity — are operated by third parties who control their own ranking and citation behavior and change it without notice. We make no promise that using GoBlume will produce any particular visibility, citation, traffic, ranking, or revenue outcome.

6. Acceptable use

You agree not to:

• Break the Site, or try to — no scraping at volume, no automated flooding of forms, no attempts to bypass rate limits or security;
• Probe or access parts of the Site you have not been given access to, including areas gated before launch;
• Use the Site for anything unlawful, or to infringe anyone’s rights;
• Copy, republish, or resell the Site’s content as your own, or use it to build a competing service.

We may suspend or block access to anyone who does these things.

7. Intellectual property

The Site and everything in it — text, design, graphics, the GoBlume name and logo — belong to us or our licensors, and are protected by intellectual property law. You may view and share the Site normally; you are not granted any other rights to it.

Feedback

If you send us ideas, suggestions, or feedback, you grant us an unrestricted, royalty-free right to use them without obligation or compensation to you. Please do not send us anything you consider confidential.

8. Third-party services and links

The Site relies on third-party providers and may link to third-party sites. We do not control them and are not responsible for their content, availability, or practices. Their terms and privacy policies apply to your use of them.

9. Disclaimer of warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION ON IT IS ACCURATE OR COMPLETE.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOBLUME WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS ($100). Because the Site is free and no payment is taken before launch, this reflects the bargain between us.

Nothing in these Terms excludes liability that cannot be excluded by law, including for fraud or for death or personal injury caused by negligence.

11. Indemnity

You agree to indemnify us against claims, losses, and reasonable legal costs arising from your misuse of the Site or your breach of these Terms.

12. Changes to these Terms

We may update these Terms. If we do, we will change the date at the top of the page, and for material changes we will email waitlist subscribers. Continuing to use the Site after a change means you accept the updated Terms.

13. Termination

You may stop using the Site at any time and remove yourself from the waitlist by unsubscribing or emailing us. We may suspend or discontinue the Site, or any part of it, at any time. Sections 5 through 11 survive.

14. Governing law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules, and any dispute will be brought in the courts located there. If you are a consumer, this does not deprive you of the protection of mandatory laws in your country of residence.

15. General

These Terms, together with our Privacy Policy, are the entire agreement between us about the Site. If a provision is found unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it. You may not transfer these Terms; we may transfer them in connection with a merger, acquisition, or sale of assets.
